Festive Season Public Holiday Entitlements

With the festive season right around the corner, everyone is excited to head out of the office for some well-deserved time to recharge with their friends and family. With time off, there may be some questions about the upcoming public holidays and employee entitlements. Now is the time to prepare for your Christmas payroll to provide your team with their correct entitlements.


Public Holidays:

This silly season, all of the Christmas and New Year holidays fall on weekdays. All employees that have their usual work days fall on a Monday or Tuesday, will be entitled to their standard pay for these days.

  • Monday, 25th December: Christmas Day

  • Tuesday, 26th December: Boxing Day

  • Monday, 1st January: New Year’s Day

  • Tuesday, 2nd January: Day after New Year’s Day


Things to remember:

  • If a Public Holiday falls inside your annual shutdown period, then you are still required to pay Employees for the days they would usually work

  • You must give Employees 14 days’ notice of your annual shutdown

  • If it is unclear what the Employee’s normal working days are, then consider the following factors:

    • Their Employment Agreement – are they casual or permanent?

    • Their work patterns – e.g. rosters

    • What are your reasonable expectations that the Employee would work on the day concerned?
